Scott T. Earle

Scott Earle is the Managing Shareholder of the Wilmington, Delaware office and a member of the firm’s Business Practice Group where he focuses his practice on all aspects of commercial and civil litigation.

Scott frequently appears before the United States District Court for the District of Delaware, the Delaware Supreme Court, the Delaware Court of Chancery and the Delaware Superior Court.

Scott also regularly appears in all state and federal courts in the jurisdictions of New Jersey and Pennsylvania where he is admitted and regularly appears before the American Arbitration Association.

Scott has significant experience in construction litigation, representing owners, developers, general contractors, subcontractors, architects, and material suppliers in contract disputes, bond claims, collections, and mechanics’ liens.

Scott also has significant experience serving as Delaware counsel on behalf of creditors in adversary proceedings and contested hearings before the United States Bankruptcy Court, District of Delaware.

In addition to practicing law, Scott serves as a Deputy Judge Advocate General for the Delaware Army National Guard.  In 2006, Scott deployed to Iraq as a member of the New Jersey Army National Guard where he served with the 1-167th Cavalry, 1st Brigade, 34th Infantry Division.  Scott was awarded the Bronze Star Medal for his service in Iraq.

Scott is a former Deputy Attorney General for the Delaware Department of Justice.

While in law school, Scott was the Lead State Constitutional Law Editor for the Rutgers Law Journal.  After graduating from law school, Scott served as the law clerk for the Honorable Joseph F. Lisa, New Jersey Superior Court, Appellate Division.

Representative Matters

Commercial Litigation

Served as local counsel for a large financial institution, which sought relief from the automatic stay in a contested hearing before the United States Bankruptcy Court, District of Delaware. The Court granted relief from the automatic stay, despite substantial opposition from various car dealerships. The large financial institution was permitted to sell 900 automobiles through an online Internet auction that resulted in full recovery.

Commercial Litigation

Successfully argued an appeal before the Delaware Supreme Court, maintaining a default judgment and mechanic's lien against a substantial commercial property. The matter favorably impacted the state’s excusable neglect case law, requiring out-of-state entities to retain Delaware local counsel despite having out-of-state counsel or risk being subject to a default judgment.
