Paul M. Schmidt Quickly Resolves Penalties for Alleged Stormwater Erosion Control Violations at Construction Site

Paul M. Schmidt, Chair of the Firm’s Environmental and Energy Practice Group, recently settled a penalty action filed by the Pennsylvania Department of Environmental Protection (PADEP). In its complaint, PADEP sought penalties for alleged violations at a construction site in Chester County, PA. PADEP alleged that the client had failed to stabilize the site, install and maintain erosion and stormwater controls, and permitted pollutants to reach a nearby stream. Mr. Schmidt quickly distilled over a year of site activities and demonstrated to PADEP numerous intervening causes of the alleged violations, enabling the client to settle the matter on fair and favorable terms, before even incurring costs to answer the complaint and discovery.
