Zarwin Attorney Wins Defense Verdict in Death Case
In this case, the plaintiff filed suit against the Keystone Freight trucking company for wrongful death. The plaintiff, 21 year old Stanley Zalinski, died when he collided with a Keystone Freight truck in the parking lot of the Oxford Valley Mall in April, 2000. The plaintiff claimed that at the time of the accident, the truck was in Mr. Zalinski's lane of traffic, moving in reverse, and that was what caused the collision.
Attorney Joe Toddy, who represented Keystone Freight, thought the accident happened differently. Although the Keystone Freight truck was indeed in Mr. Zalinski's lane, it was not moving at the time of the accident. In fact, the truck was within Mr. Zalinski's clear sight from 300 feet away, giving Mr. Zalinski ample opportunity to maneuver around the truck so as to avoid a collision. Further, as opposed to being killed by the impact of the collision, Toddy believed that Mr. Zalinski suffered a heart attack prior to the impact, which was actually the cause of his death.
Zalinksi brought suit in Bucks County . After trial, the jury deliberated for approximately one hour and fifteen minutes and concluded that the Keystone Freight driver did not negligently operate the motor vehicle.
