Zarwin Attorney Successful in Defending Superior Court Appeal Regarding Recent Amendments to Mechanics' Lien Law

The Superior Court recently issued an Opinion in a case argued and briefed by Ryan D. Harmon, Esq., regarding the 2006 Amendments to the Pennsylvania Mechanics' Lien Law.  The Superior Court determined, among other things, that certain mechanics' lien waivers entered into prior to the effective date of the 2006 Amendments were applicable to related projects which began after the effective date of the 2006 Amendments.  The Superior Court also interpreted the lien waiver sections of the Mechanics' Lien Law and the impact of the 2006 Amendments on mechanics' lien waivers.  The Opinion was one of the first opinions published regarding the 2006 Amendments to the Mechanics' Lien Law and is published under Floors, Inc. v. Altig, 963 A.2d 912 (Pa. Super. 2009).
