Anton Marzano Obtains Summary Judgement In The Superior Court Of New Jersey

Anton G. Marzano, Esquire, a partner in the Firm’s Casualty Defense Practice Group recently obtained summary judgment in the Superior Court of New Jersey, Morris County, in a personal injury case involving a construction site accident.  In the Complaint, plaintiff alleged that the firm’s client was responsible for overseeing, maintaining and controlling the job site and the safety procedures for the workers at the site.  Plaintiff while on the roof of the steel structure for the building fell twenty-six (26) feet to the ground sustaining fractures to his left elbow, arm, wrist and pelvis.  Plaintiff underwent a surgical procedure for radical excision of heterotopic bone and elbow contracture to release both interior and posterior, excision of heterotopic bone in the interior coronoid process with proximal radial and ulnar synostosis, interior transposition of the ulnar nerve subcutaneously.  He also underwent surgery for open reduction and internal fixation of distal humeral fracture intra-articular extension and comminution.

The Complaint and all cross claims of co-defendant were dismissed with prejudice.  Mr. Marzano successfully argued to the Court that the firm’s clients had no responsibility regarding the overseeing of the work being performed at the accident site or safety procedures.
