Noncompete Claim Rejected!

David McComb recently defeated an injunction action brought by a bank in the Court of Common Pleas of Lancaster Country against a former bank employee client employed in another state. McComb was successful in persuading the Court to deny the injunction request based on the language of the noncompete agreement between the bank and the employee and his legal arguments regarding the claims of harm the bank claims to have sustained. McComb argued that an injunction was an inappropriate remedy for the claims presented by the bank, and the Court agreed and denied the injunction request.
