Bryan P. Werley

Bryan P. Werley is a shareholder at Zarwin Baum, concentrating his practice on matters of particular importance as one of the firm’s leaders and handles some of the firm’s more complex and cutting-edge high-exposure cases. Mr. Werley has gained extensive trial experience in over 20 years of practicing law and has sat first chair in both state and federal courts in significant cases. He has represented Fortune 100 companies, closely held companies, and individuals.

Although Mr. Werley also handles a variety of high value general liability matters, he takes particular pride in being considered a “lawyer’s lawyer” representing and defending professionals, including lawyers, architects, and other professionals in matters involving allegations of professional liability. A focus of Mr. Werley’s practice has been the zealous and mindful defense of professionals across a spectrum of industries and fields. He defends employers and professional employer organizations in claims involving civil rights, discrimination, harassment, retaliation, and wrongful termination matters in state and federal courts and on appeal. On every matter, he takes pains and meticulous measures to understand his client’s areas of concentration and to prepare a defense mindful of the unique concerns they have when it comes to their professional practices.

Bryan has extensive experience trying and litigating cases in the construction and transportation industries. He has handled some of the more complex construction accident and construction defect cases against the most formidable adversaries in Philadelphia and the surrounding counties.
Bryan lectures his fellow colleagues with respect to federal and state practice and is a founding member of the Themis Advocate’s Group’s NexGen committee as a thought leader by bridging the generational divide in trial practice and firm succession.

In his practice, he defends his clients against claims for serious injuries and catastrophic loss in a wide range of industries. He defends employers and professional employer organizations in claims involving civil rights, discrimination, harassment, retaliation, and wrongful termination matters in state and federal courts and on appeal. He handles a variety of matters involving serious injury and death occurring in connection with transportation, trucking, construction, demolition, premises liability, and the use or misuse of consumer products. Although he values and tries to resolve cases early in their life, he is ever conscious that many cases will go to trial and prepares them accordingly.

In a high-stakes, nearly three-week trial, Zarwin Baum attorneys Bryan Werley and Breana Barker secured a decisive defense victory in a New Jersey real estate fraud case. Representing a real estate broker and agent involved in the sale of a Haddonfield, New Jersey duplex, the legal team adeptly navigated through a web of complex legal issues to obtain a full defense verdict.

Summary Judgment Granted in Favor of Contractor in Unfair Trade Practices Claim

Zarwin Baum recently obtained summary judgment on behalf of a framing contractor against whom claims were brought arising from the contractor’s work on a new construction residential property. In the case, the plaintiff homeowners claimed that they hired a general contractor, who in turn, hired the framing contractor to build the home and that the construction was done improperly, resulting in pinging and squeaking in the home. Plaintiffs sought the cost to repair or rebuild the home as well as treble damages pursuant to the Unfair Trade Practices and Consumer Protection Act. Plaintiffs also asserted a claim for unjust enrichment, claiming the defendants were enriched by the payments made for the construction without receiving the benefit of same. Bryan Werley, a partner at Zarwin Baum who handles a variety of complex matters, including construction defect cases, defended the claim and was able to establish both factual and legal defenses to the case. Werley argued that the claims for unjust enrichment should be dismissed because Plaintiffs themselves dealt with their general contractor and any benefit conferred was conferred to the general contractor, and not the framing contractor directly. The relationship between the general contractor and the framing contractor was established pursuant to a written contract and permitting Plaintiffs to subvert that through a direct unjust enrichment claim would subvert the duties and responsibilities negotiated by the framing contractor with the general contractor. The Court granted summary judgment and dismissed the claim for unjust enrichment. With respect to the claim for Unfair Trade Practices, the Plaintiffs’ theories rested upon allegations that the framing contractor made representations to the homeowners regarding the nature and quality of the work being performed. Through discovery, Zarwin Baum attorneys established that at no time did the framing contractors every have any direct communication with the homeowners and, even if they were present at the same time as the homeowners, the homeowners only spoke English and the contractors only spoke Spanish so no representations were made nor could they have been communicated. The Court agreed, granting summary judgment on this count and dismissing the only remaining claims against Werley’s client.
