Philip J. Odett

Philip J. Odett primarily focuses his practice on insurance defense matters, including premises liability, construction accidents, products liability, motor vehicle accidents and liquor liability, including Dram Shop. Philip has successfully defended numerous insurance carriers and self-insured companies throughout his career. Philip has an exceptional reputation with his clients, colleagues, and judges.

From 2007-2016, Philip worked at a mid-sized law firm with offices in New York and New Jersey, practicing in the field of insurance defense. Philip handled cases from inception up to and including trial.  During his tenure, Philip won numerous motions for summary judgment and mediated several multi-million dollar cases.

Philip graduated from the University of Wisconsin and Seton Hall University School of Law. While in Law School, Philip completed a summer abroad program in Italy. Philip is admitted to practice law in New York and New Jersey State and Appellate Courts, as well as the United States District Court for the Southern and Eastern Districts of New York and the United States District Court for the District of New Jersey. Philip is also a member of the American Bar Association.

Representative Matters

Automobile Insurance Coverage & Liability

Philip J. Odett represented an individual whose vehicle was rear-ended in Freehold, New Jersey.  After the initial impact, Mr. Odett’s client’s vehicle came in contact with plaintiff’s vehicle.  Plaintiff sustained severe injuries and underwent lumbar decompression and fusion surgery.  Upon the close of discovery, Mr. Odett prepared and filed a motion for summary judgment on behalf of his client.  The judge concurred with Mr. Odett’s arguments and granted summary judgment to Mr. Odett’s client.  All claims and cross-claims asserted against Mr. Odett’s client were dismissed with prejudice.

Obtained involuntary dismissal after plaintiff alleged that she tripped and fell at a casino. During the mandatory arbitration, Philip J. Odett successfully argued that the defendant was not on notice of any defects or foreign substances. The arbitrator did not apportion any liability to the defendant and concluded the defendant was not liable for plaintiff’s incident. Judge Alvaro Iglesias subsequently granted defendant’s motion dismissing all claims against the defendant with prejudice.
