Robert is an experienced litigator. He has litigated complex commercial cases throughout the United States, and consistently obtained exceptional results.
Robert is a partner in Zarwin Baum’s commercial litigation group. Robert possesses extensive experience in all aspects of complex commercial litigation, including, but not limited to, discovery (including e- discovery and fact and expert depositions), motion practice, evidentiary hearings, trial practice and appellate work. Robert’s experience includes exercising principal day-to-day responsibility for numerous cases involving a myriad of subject matters, ranging from contract disputes, employment matters and questions of officer and director liability to business divorce, securities fraud and environmental and construction litigation.
Prior to joining Zarwin Baum, Robert was the founder and managing partner of the Brookman Law Group. In that capacity, Robert represented individuals, businesses and organizations in a variety of court and arbitration forums, and regularly obtained exceptional results. Robert started the Brookman Law Group after a successful practice with a firm in Montgomery County, with a focus on complex commercial disputes.
Robert received his J.D. from The George Washington University Law School in 2011. During law school, Robert was a member of the Moot Court Board, and won the award for the best brief written in a law school wide moot court competition. Prior to law school, Robert graduated with highest honors from Johns Hopkins University, with a degree in political science.
Robert is licensed in New York, New Jersey and Pennsylvania, though he has successfully litigated, arbitrated and mediated cases throughout the United States. Robert is admitted to practice before the United States Court of Appeals for the Third Circuit, and the United States District Courts for the Southern District of New York, the Eastern District of New York, the District of New Jersey and the Eastern District of Pennsylvania. Robert is also a member of the American Bar Association. Outside the practice of law, Robert enjoys rooting for Philadelphia sports teams, reading history, biographies and current events, and playing chess.
•Represent fire department and EMTs in connection with a multi-million-dollar wrongful death suit alleging that the EMTs failed to transport an infirm individual to the hospital following an emergency call, resulting in the individual’s death and liability pursuant to Section 1983.
•Represent animal rescue facility in appeal before the United States Court of Appeals for the Third Circuit in case involving allegations of improper confiscation and euthanasia of animals and liability pursuant to Section 1983.
•Represent former employee in complex multi-million-dollar whistleblower suit alleging wrongful termination, breach of fiduciary duty, breach of contract and liability pursuant to the New Jersey Conscientious Employee Protection Act.
•Represent a hedge fund in an arbitration pending before the Financial Industry Regulatory Authority (FINRA) in a matter involving allegations of unauthorized trading and breach of contract, resulting in the destruction and dissolution of the fund.
•Represented multiple defendants in multi-million-dollar suit involving a multi- faceted lending transaction and the alleged breach of a half-dozen interrelated contracts.
•Represented homeowner in construction litigation alleging default in construction of residential property.
•Represented former employee in Title VII suit alleging discrimination in employment and retaliation in response to protected activity.
•Obtained a favorable settlement at mediation in complex securities litigation involving claims of breach of fiduciary duty against the officers and directors of a corporation and further seeking the reversal of stock issuances and a merger in a case filed in the U.S. District Court for the District of Delaware.
•Secured indemnification and release in an environmental suit filed in the U.S. District Court for the District of New Jersey by demonstrating that the remediation at issue should never have occurred because the contractor applied the wrong regulatory standard in determining that my client furnished concrete containing chemical concentrations above that permitted by law.
•Obtained two (2) separate Consent Judgments, each in the amount of $890,000, in favor of a group of investors defrauded in connection with the financing of a feature film after three (3) years of highly contentious litigation involving voluminous discovery and motion practice as well as a bankruptcy dispute in the U.S. Bankruptcy Court for the District of New Jersey.
•Obtained favorable settlement after participating in a mediation before the Chief Magistrate Judge for U.S. District Court for the Southern District of New York, in a complex commercial case involving claims of, inter alia, breach of contract, tortious interference and civil conspiracy.
Corporate and Business
Represented an entrepreneur who owned a manufacturing company in a recapitalization transaction completed as an F Reorganization with a private equity group which provided a partial buy-out and the entrepreneur retaining a 40% interest in the enterprise.
