Career Biography

Philip J. Odett primarily focuses his practice on insurance defense matters, including premises liability, construction accidents, products liability, motor vehicle accidents and liquor liability, including Dram Shop. Philip has successfully defended numerous insurance carriers and self-insured companies throughout his career. Philip has an exceptional reputation with his clients, colleagues and judges. 
From 2007-2016, Philip worked at a mid-sized law firm with offices in New York and New Jersey, practicing in the field of insurance defense. Philip handled cases from inception up to and including trial.  During his tenure, Philip won numerous motions for summary judgment and mediated several multi-million dollar cases.  
Philip graduated from the University of Wisconsin and Seton Hall University School of Law. While in Law School, Philip completed a summer abroad program in Italy. Philip is admitted to practice law in New York and New Jersey State and Appellate Courts, as well as the United States District Court for the Southern and Eastern Districts of New York and the United States District Court for the District of New Jersey. Philip is also a member of the American Bar Association. 

Representative Matters

Philip J. Odett represented an exterminator that was retained to perform monthly examinations of a hotel in North Bergen, New Jersey.  While on vacation, plaintiff alleged he was bitten by an insect or spider in his hotel room.  As a result of the insect or spider bite, plaintiff was hospitalized for over a week with severe leg and knee injuries.  Mr. Odett prepared and filed a motion for summary judgment on behalf of his client.  During oral argument, Mr. Odett successfully argued his client was not negligent and did not bear any liability.  Judge Rose granted Mr. Odett’s motion for summary judgment and dismissed all claims and cross-claims with prejudice. 

Obtained summary judgment in a trip and fall accident. Philip J. Odett represented a building owner and landlord in a case where plaintiff allegedly tripped and fell on a pedestrian ramp abutting the sidewalk. As a result of the accident, plaintiff sustained a fracture to her right hip requiring surgery and a month long hospitalization. At the close of discovery, Mr. Odett filed a motion for summary judgment arguing the property owner was not responsible for the pedestrian ramp where plaintiff fell. The presiding Judge agreed and granted Mr. Odett's motion for summary judgment after oral argument.
Defended a property owner in a matter where plaintiff allegedly tripped and fell on a sidewalk abutting the owner’s property. As a result of the incident, plaintiff sustained a fracture of the right humeral neck. Upon the close of discovery, Philip J. Odett filed a motion for summary judgment in which he argued the property owner was not liable. After oral argument, the Judge granted summary judgment in favor of Mr. Odett’s clients.
Philip J. Odett represented a restaurant and bar that plaintiff brought a Dram Shop action against after being struck by an automobile. Plaintiff suffered severe head injuries and a collapsed lung as a result of the incident. Mr. Odett argued his client was not liable for the happening of the incident.  Mr. Odett specifically argued that plaintiff failed to establish the restaurant and bar served alcohol to plaintiff when he was visibly intoxicated. Plaintiff was unable to rebut Mr. Odett’s argument and the case ultimately settled for $6,000 prior to summary judgment motions being filed. 
Obtained summary judgment after plaintiff slipped and fell on a marble floor in a casino. As a result of the fall, plaintiff sustained a comminuted fracture of her right shoulder. At the close of discovery Philip J. Odett moved for summary judgment arguing there was no foreign substance on the floor and that there was no expert testimony to establish that the marble floor where plaintiff fell was inherently slippery or dangerous. The trial court agreed and granted Mr. Odett's motion for summary judgment dismissing plaintiff’s complaint with prejudice.
Philip J. Odett represented a casino after plaintiff alleged she tripped at the top of an escalator and subsequently tumbled down the entire flight of steps. As a result, plaintiff suffered significant lower back and neck injuries. Plaintiff argued there was a gap in between the escalator platform and the first step of the escalator which constituted a hazardous condition and thereby caused her to fall. Mr. Odett successfully argued defendant’s summary judgment motion before the Honorable Charles A. Little. At oral argument, Mr. Odett persuaded the court that his client was not negligent as the escalator plaintiff allegedly fell down was not defective. Judge Little granted defendant’s motion for summary judgment motion and dismissed plaintiff’s complaint with prejudice.
Obtained involuntary dismissal after plaintiff alleged that she tripped and fell at a casino. During the mandatory arbitration, Philip J. Odett successfully argued that the defendant was not on notice of any defects or foreign substances. The arbitrator did not apportion any liability to the defendant and concluded the defendant was not liable for plaintiff’s incident. Judge Alvaro Iglesias subsequently granted defendant’s motion dismissing all claims against the defendant with prejudice.
