Career Biography

Eitan D. Blanc is a senior associate in Zarwin Baum’s Commercial Litigation and Professional Liability practice groups. Eitan's practice focuses on handling complex commercial litigation, including business disputes, business torts and class actions. Eitan also has extensive experience defending lawyers, accountants and real estate appraisers against complex professional liability claims. Eitan handles all aspects of civil litigation from inception through conclusion, including arbitration, trial, settlements and appeals.

Upon graduation from law school, Eitan served as an Assistant District Attorney at the Philadelphia District Attorney’s Office. He was the lead prosecutor for jury and bench trials in a wide range of cases including attempted murder, aggravated assault, robbery, drug offenses, weapons offenses, fraud and forgery. Eitan uses his significant trial experience advocating for the clients of Zarwin Baum.

Eitan received his J.D. from Temple University’s James E. Beasley School of Law in 2007. While attending law school, he earned inclusion on the Dean’s list and was noted for distinguished class performance in his introduction to trial advocacy class. Prior to law school, Eitan graduated from The Pennsylvania State University in 2003 where he received a Bachelor of Science degree in Business Logistics and International Business.

Eitan is admitted to practice law in Pennsylvania, New Jersey and before the United States District Courts for the Eastern District of Pennsylvania and the District of New Jersey. He is a member of the Philadelphia Bar Association and the Brandeis Law Society.

Representative Matters

Obtained dismissal on appeal of a class action brought against a fitness facility under New Jersey’s Truth in Consumer Contract Warranty and Notice Act. Adopting the arguments presented in the briefing and at oral argument, the Appellate Division reversed the entry of judgment in plaintiff’s favor and further reversed the order certifying a class. The Appellate Division then remanded the matter to the trial court with directions to enter judgment in favor of the fitness facility, thus ending a multi-year legal battle and eliminating, in its entirety, a multi-million dollar potential class liability.      

Obtained dismissal of New Jersey professional malpractice claim upon the filing of a motion to dismiss for failure to file an affidavit of merit. The motion was granted, dismissing a complaint based on allegations that an insurance producer was negligent for allegedly failing to procure proper insurance coverage. The decision was appealed to the Appellate Division, which upheld the dismissal. 

Obtained dismissal of a legal malpractice claim upon sustaining of preliminary objections where plaintiff alleged an attorney was retained to represent him but failed to complete any legal work. 

Obtained dismissal of a wrongful use of civil proceedings (Dragonetti Act) claim upon sustaining of preliminary objections. The action was commenced against attorneys based on their involvement with a federal breach of contract action and subsequent appeal. 

Defended a legal malpractice action with claimed damages in excess of two million dollars. Plaintiff paid defendants in a settlement achieved while a defense motion for summary judgment was pending. 

Defended a malpractice claim against accountants arising from allegations that accountants improperly prepared corporate tax returns. 

Defended multiple legal malpractice claims arising from missed statutes of limitations.

Defended a real estate appraiser against allegations that appraiser inflated the value of a luxury home.  

Obtained dismissal of New Jersey legal malpractice claim upon the filing of a pre-answer motion to dismiss the third party complaint for failure to state a claim upon which relief can be granted. The motion was granted, dismissing a third party complaint based on allegations that a law firm was negligent for allegedly failing to advise its client to report a lawsuit to the client’s insurance broker.
