Anthony R. Twardowski

Anthony R. Twardowski is the Chairman of the Commercial Litigation Department at Zarwin Baum where he oversees a team of highly skilled and focused litigators dedicated to ensuring that their clients’ business disputes are resolved effectively and pragmatically. Anthony and his team provide creative, yet practical dispute resolution guidance, always aimed at fulfilling their clients’ business goals and objectives in the most cost-effective manner possible.

Anthony concentrates his practice on complex commercial litigation, including partnership and corporate governance disputes, real estate litigation, title insurance, professional liability, class action defense and surety, fidelity and construction. Anthony has extensive litigation expertise in a wide variety of other substantive commercial areas, such as environmental, lender liability, RICO, insurance liquidation, intellectual property, consumer protection and creditor rights.

Anthony’s broad experience includes jury and non-jury trials in many state and federal courts, numerous arbitrations and mediations, and a variety of appellate proceedings. In addition, Anthony has significant skill in international litigation, having overseen parallel litigation for nearly a decade, involving substantial surety, construction and indemnity claims, pending in New York federal court and in various courts throughout Brazil.

Anthony received his B.B.A., magna cum laude, from Temple University in 1979. At graduation, he was presented with the Temple School of Business prestigious Economics Award for graduating first in his class in that major. Anthony continued his education at Temple’s School of Law, where he received his J.D., cum laude, in 1982 after serving as an editor of the Temple Law Quarterly. Following graduation, he clerked for two years for the Honorable Harry A. Takiff of the Philadelphia Court of Common Pleas and spent the next 25 years as an associate and partner at a large Philadelphia-based law firm before joining Zarwin in 2009.

Anthony is admitted to practice in Pennsylvania and before the United States District Courts for the Eastern, Middle and Western Districts of Pennsylvania and the United States Court of Appeals for the Third Circuit. He also has appeared before state and federal trial and appellate courts in California, Colorado, Delaware, Florida, Massachusetts, New Jersey, New York and Texas.

Anthony’s professional activities include involvement with the National Bond Claims Association, the Surety Claims Institute, the Philadelphia Surety Claims Association, the American Bar Association (Litigation Section, Tort and Insurance Practice Section and Forum on the Construction Industry), Pennsylvania Bar Association and Philadelphia Bar Association.

Representative Matters

Breach of Contract

Obtained a multi-million dollar federal court judgment on behalf of banking client against a co-borrower and two guarantors of a commercial mortgage loan, concluding nearly four years of hard fought litigation.  

Breach of Contract

Secured a nearly $1 million foreclosure judgment on behalf of banking client, defeating at trial borrower claims that the mortgage was unenforceable due to fraud. The case presented challenging evidentiary obstacles due to the death of a co-borrower, which Tony addressed through creative, and ultimately effective, cross examination of the surviving borrower.
