Zarwin Baum Secures Summary Judgment in Favor of Ride Share Driver

The Plaintiff alleged that the driver was negligent in where he positioned his vehicle and should have been aware that he was parked near a pothole. Greg argued that there was simply no requirement or case law that supports the concept that a driver examine the condition of a roadway before his customer enters the vehicle.

After substantial briefing and oral argument, the court issued a six page opinion accepting Greg’s arguments and holding that to “impose a duty of care” on a ride share driver in this specific situation “does not comport with fairness or public policy” and “such a result” would “establish rules of conduct that are ‘intelligible and sensible'”.
