Defense Verdict in Philadelphia County Automobile Liability Action

June 25, 2014

After a four-day trial in Philadelphia, Joseph F. Longo received a defense verdict on behalf of their client (the owner of a parked car) in this automobile liability action.  The plaintiff, who was represented by J. Conor Corcoran, originally demanded over $200,000 to settle the case.  The plaintiff alleged that he was hit by a truck as he was crossing the street in Philadelphia.  The driver of the truck alleged that he was unable to see the plaintiff crossing the street because two illegally parked cars adjacent to the intersection blocked his view.  The plaintiff had ankle surgery and scarring as a result of the accident.  Attorney Longo received a defense verdict at the arbitration of this matter.  Prior to trial, the Judge granted defense counsel’s motion in limine to preclude any reference to the cars being illegally parked.  Attorney Longo successfully defended the client at trial and received a defense verdict on behalf of the client.  He was able to establish that the driver of the truck did not even see his client’s car before striking the plaintiff.  He was also able to successfully argue that the plaintiff was at fault for the accident as he was skate boarding across the intersection at the time.  The jury found that there was no negligence on the part of any of the defendants.
