Zarwin Baum Attorneys Secure a Favorable Verdict for Commercial Landlord

Philip Magen secured a verdict in favor of their client, a commercial landlord (“Landlord”), in a dispute against a former tenant (“Tenant”). Tenant filed suit against Landlord claiming it had been constructively evicted due to ongoing construction at the leased premises (“Premises”). Tenant sought damages for costs incurred in connection with moving, increased rent at its new location and return of its security deposit. Landlord counterclaimed, alleging Tenant breached the lease agreement (“Lease”) by failing to provide timely notice of its intent to exercise Tenant’s early termination rights under the Lease. Landlord  sought damages for unpaid rent, costs incurred based upon Tenant’s failure to properly surrender the Premises, costs incurred in connection with Landlord’s efforts to re-let the Premises and attorneys’ fees and costs. Following a two day trial, the Philadelphia Court of Common Pleas ruled in favor of the Landlord and awarded the full amount of its claimed damages, including attorneys’ fees and costs.
