Court Awards Past And Future Commissions To Real Estate Broker Under Commercial Lease Commission Agreement

May 28, 2013

Following a hotly-contested three day non-jury trial, Anthony Twardowski and Scott Goldstein secured a judgment on behalf of a real estate broker, who was awarded past due commissions for having secured a commercial tenant for the defendant’s property as well as a declaration of entitlement to future commissions for so long as the tenant occupies the premises.  While the defendant was free to terminate the broker’s lease administration services because the broker’s dishonest employee delayed remittance of three rental payments for several months, the Court agreed with Twardowski and Goldstein that the broker’s right to commission for procuring the tenant over thirty years ago remained intact.
